1. Introduction

Welcome to Avant Ops. These Terms of Service ("Terms") govern your use of our website, products, and services. By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy.

2. Use of Services

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to use our services:

  • In any way that violates any applicable federal, state, local, or international law or regulation.
  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation.
  • To impersonate or attempt to impersonate Avant Ops, an Avant Ops employee, another user, or any other person or entity.
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of our services, or which may harm Avant Ops or users of our services.

3. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of Avant Ops and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Avant Ops.

4. Client Projects and Deliverables

For client projects, Avant Ops will deliver work as outlined in the agreed-upon statement of work or project agreement. Upon full payment, clients will receive ownership rights to the final deliverables as specified in the project agreement, subject to the following:

  • Avant Ops retains ownership of any pre-existing materials, frameworks, or methodologies used in the creation of the deliverables.
  • Avant Ops reserves the right to display and link to your project as part of our portfolio and to write about the project on websites, in magazine articles, and in books about web design.
  • For projects involving open-source software, the respective open-source licenses will apply to those components.

5. Payment Terms

For project-based work, payment schedules will be outlined in the project agreement. Typically, this includes:

  • An initial deposit before work begins
  • Progress payments at predetermined milestones
  • Final payment upon project completion

For ongoing services, payments are typically made on a monthly basis. Late payments may be subject to penalties as outlined in the service agreement.

6. Hosting & Support Plans

Avant Ops offers the following service plans:

  • Core Hosting: Includes website hosting and uptime monitoring. No support or development hours are included. Infrastructure-related issues (e.g., server downtime) are covered. Content updates, feature changes, or user-caused issues are billed separately.
  • Essentials Plan: Includes hosting, uptime monitoring, and 1 hour of development or support time per month.
  • Growth Hosting: Includes hosting, uptime monitoring, and 3 hours of development or support time per month at a discounted hourly rate.

Support & Development Hours

  • The included support hours are use-it-or-lose-it and do not roll over to future months.
  • Additional work beyond the included hours is billed at:
    • $125/hour for Core Hosting and Essentials Plan clients
    • $100/hour for Growth Hosting clients
  • Support time may be used for:
    • Minor content updates
    • Bug fixes
    • Website adjustments or light development tasks
  • Larger projects or feature development may be scoped separately and quoted accordingly.

Billing & Cancellation

  • All hosting plans are billed monthly and renew automatically via Stripe unless otherwise agreed in writing.
  • You may cancel anytime before the next billing cycle to avoid being charged for the following month.
  • Late or failed payments may result in service suspension after a reasonable grace period.

7. Project Timeline and Scope

Project timelines are estimates based on the agreed scope of work. Delays may occur due to:

  • Client feedback delays
  • Changes to the project scope
  • Technical challenges discovered during implementation

Any work that falls outside the original scope will be considered a change request and may affect the timeline and cost of the project.

8. Limitation of Liability

To the maximum extent permitted by law, Avant Ops shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use our services
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from our services
  • Any bugs, viruses, or other harmful code that may be transmitted to or through our service by any third party

9. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

For ongoing service agreements, termination procedures will be as outlined in the service agreement, typically requiring written notice within a specified timeframe.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
